Rape accused: 'One of us is lying — and it's not me'

A MAN accused of rape has denied having "one last throw of the dice" by having sex with a woman before his planned sex change.

Nadine Williams, also known as Dean, took to the witness stand on day four of his trial at Swansea Crown Court.

Williams, 39, of Dan-y-coed, Tonmawr, denies rape and two further counts of assault by penetration.

He told the jury he is transgender and is undergoing the process of changing sex.

Williams said on October 4, 2011, he met the woman outside a pub in Neath and bought them dinner and two bottles of wine.

He said the pair had been flirting throughout dinner.

"She said something about my eyes. She said 'Don't give me those eyes'," said Williams.

After dinner, Williams said the woman asked him to take her to a house in Neath where he was staying.

The house, he had told her, had a bedroom converted into an S&M, or sadomasochism, room known as The Dungeon.

Williams said the woman told him "Take me to the dungeon", and the pair stopped to buy three bottles of wine before taking a taxi to the address.

He said that when the pair arrived home they kissed in a hallway before drinking wine in the living room.

Williams said they later went upstairs and began kissing again, before they both undressed themselves and had sex in a bedroom.

Williams, 39, of Dan-y-coed, Tonmawr, said the pair later went downstairs, but returned to the bedroom a second time and began kissing again.

He said an argument broke out between the pair and she "pawed" Williams in the face, and when she knocked his nose piercing he had a nose bleed.

Williams said she then left the house.

Geraint Walters, for Williams, said: "Did you carry out any sexual actions when she wasn't agreeing to them?"

Williams replied: "No."

Mr Walters asked: "Did you, for one moment, think she wasn't agreeing to these sexual acts?"

Williams replied: "No."

Williams was also asked about 49 marks or bruises recorded on the woman's body by a doctor the following day.

Williams said he had seen just one scratch when she left, but admitted it had been caused by his false nails.

The prosecution alleges Williams pinned the woman down on the bed and forced her to have sex with him before completing two sex acts on her, once in the bedroom and then again in a downstairs bedroom.

They say the woman then fled the house, leaving items of her clothing, including her top and jeans in the house.

Williams was then cross-examined by barrister Huw Rees.

Mr Rees asked why police found the woman's underwear, top and jeans in the Neath house where the assault is said to have happened.

The prosecution allege she left her clothing behind in a rush to escape Williams's "violent sexual assault".

Mr Rees said: "It's an unusual thing for a lady to do, leave her knickers behind?"

Williams replied: "Yes, I wouldn't leave mine behind".

Mr Rees asked: "Is it in your sensitive state, moving from one sex to another … you wanted one last throw of the dice (as a man) and wanted to have sex with her?"

"No," Williams replied.

He also denied creating a "web of lies" in his account of the night's events.

Mr Rees said: "You can't think of any reason she would want to make anything up against you?"

Williams replied: "No."

He asked: "One of you is telling a pack of lies?"

"Yes," replied Williams.

"You're saying it's not you, so she's making all this up for no reason whatsoever," he asked.

"Yes," replied Williams.
