Judge rips up 'Crasbo' for couple
A COUPLE from Llanelli threatened with matching Asbos in the same week as Valentine's Day have been let off after staying out of trouble for three months.
Kayleigh Louise Evans, 23, of Stafford Street, and Shaun Arun Vincent Penhale, 25, of Brynsiriol, appeared at Llanelli Magistrates' Court last week for consideration of making an anti-social behaviour order on conviction — also known as a Crasbo or criminally-related Asbo.
The order was being considered following an incident in November after which Penhale was sentenced for attempted criminal damage and Evans jailed for assaulting three police officers.
But on Thursday district judge Vivian Manning-Davies ripped apart the Crasbo.
Defending, solicitor Gareth Jones said the couple had not caused any problems since being evicted from their home in Old Lodge.
"That has now been taken away from them," he said.
"That's a trigger of both parties being arrested.
"People who drink alcohol on a daily basis to excess — it's almost a party culture where every day people drink and get intoxicated."
He added that since leaving prison, Evans had been awaiting accommodation and had specifically asked not to be put near the Station Road area.
The order would have banned the couple from drinking or being drunk in public, from entering the Old Lodge area and from behaving in a manner which causes the public to be "harassed, alarmed or distressed".
Mr Manning-Davies said he did not feel there was any need for the order to be put in place.
Glad
"An Asbo as we all know is a preventative order," he said.
"Undoubtedly on behalf of both of these defendants there's been antisocial behaviour that occurred when they both lived in Old Lodge.
"Since November there have been no further arrests.
"I'm glad to hear that on behalf of the community that this court represents.
"That seems to me powerful evidence which I cannot ignore.
"Even if I'm wrong and the necessity test is fulfilled it seems to me that in any event the probation's conditions are extremely broad."
He added: "I would like to think that both of you, with proper help, will put your past very much behind you and move on with your lives."
