Guilty of raping teen as she slept at party
A LLANELLI man has been found guilty of raping a 16-year-old girl after she fell asleep at a party in Loughor.
The girl woke in horror in a spare bedroom to find Dean Cleobury having sex with her, Swansea Crown Court heard.
Cleobury, aged 22, of Rhandir, Bynea, denied rape but a jury convicted him of the 2008 sex attack by a majority verdict of 10-2.
During his trial Cleobury also denied raping two other teenage girls — a 15-year-old last summer and a 16-year-old five years ago.
The jury of six men and six women cleared him of raping the 15-year-old but failed to reach a verdict on the 2005 rape charge.
Sentencing was adjourned after barrister Geraint Walters said the prosecution needed seven days to decide the future progress of the case.
It was possible, he told Judge Keith Thomas, that the prosecution would seek a re-trial to enable a different jury to consider the charge that the present jury had failed to reach a verdict on.
The court heard that Cleobury, formerly of Culfor Road, Loughor, was arrested following a party at a house in Loughor 16 months ago.
He was a guest at the party, which was attended by some 15 teenagers.
The girl woke up about 1.30am in horror to find Cleobury on top of her, raping her.
Giving evidence, Cleobury denied being the girl's attacker — and his barrister, Frank Phillips, described the case as a "whodunnit".
But the jury heard that a forensic scientist who examined Cleobury's boxer shorts identified two "components" which matched the DNA profile of the complainant and which could not have come from the defendant or a girlfriend he had had sex with shortly before going to the party.
The 2005 allegation faced by Cleobury was made by a Loughor woman, now in her early 20s, who claimed he had sex with her without her consent when they were both in their teens
The defence case in relation to this was that intercourse was consensual.
After a retirement of more than nine hours, the jury was discharged from reaching a verdict on this after the foreman said agreement was not possible.
The youngest complainant in the trial was a 15-year-old girl who alleged Cleobury forced her to have sex in Pembrey Country Park six months ago.
Cleobury, who was cleared of raping the 15-year-old, admitted kissing and fondling her but was adamant intercourse did not take place.
He has been in custody since August.
