Decision not to suspend charity chief is defended
THE chairwoman of a Swansea-based charity has defended a decision not to suspend its chief executive over allegations of misuse of public finds.
The All Wales Ethnic Minority Association (Awema) is being investigated by the Welsh Assembly over allegations which also include nepotism and staff bullying.
It follows an independent report which found its chief executive, Naz Malik, had used Awema funds in an inappropriate way, including paying off credit card debts worth £9,340, which was claimed as an advance on future expenses.
The independent report into Awema concluded that Mr Malik should be suspended while an investigation is undertaken, and the charity's legal advisors endorsed the recommendation.
Mr Malik was instead given a written warning however, and the charity's chair has defended the decision.
Its chairwoman, Dr Rita Austin said: "Had we done what the solicitors advised it would have incurred the charity an enormous extra expense that I really could not justify on the very strong grounds that I already had, as had the trustees, a clear admission from Mr Malik over the business of the credit card.
"I have to make this judgement on behalf of the charity as I see fit, and of course I take responsibility for the decision
"However, it is my understanding that the solicitor was not provided by the trustees at that time with Mr Malik's rebuttal."
"Why didn't the trustees who are now complaining sack him at the time? I did not sack him because I felt it necessary to move immediately to disciplinary action."
The Welsh Government is due to complete an investigation into the charity's affairs next week, but the author of the independent report, Paul Dunn, says he has yet to be contacted to discuss his findings.
He said: "Nobody has been in touch yet. I am sure they will be before too long.

"The same goes for the Charity Commission, the police.
"Nobody from any organisation has been in touch with me about the evidence that I've got."
Darren Millar AM, chair of the Assembly's Public Accounts Committee, called the news "absolutely astonishing".
He said: "To contact him this late in the day when they are about to publish a report next week seems to be pretty negligent really in terms of the ongoing investigation which is taking place."
A Welsh Government spokesman said: "The priority at this stage has to be to handle the current issues with funding AWEMA.
"Only once this has been done will we be able to give proper consideration to whether lessons should be learned from the Welsh Government's history of funding AWEMA.
"The conclusions of that consideration, and any relevant reports, will be made public in due course. It would be inappropriate to comment further until that work is complete."
The report also alleges that Mr Malik's daughter Tegwen Malik, who is the charity's operations director, saw her salary increase from £20,469 in January 2008 to £50,052 in August 2011.

“t seems that today's Welsh Government report will not be addressing the human rights issues of the situation at AWEMA, frankly this is a disgrace. The misuse of Public money is of course important and those involved must be brought to account for this. However, its just money, the alleged systematic bullying of staff over what seems to be a number of years something that needs to addressed sooner rather than later. The fact that the assembly will soon be going on its mid term break is alarming to say the least. For the Assembly to be going into recess leaving this issue unresolved is to say the least unsatisfactory I have stronger words to describe this but I would probably get arrested if I wrote them.
If trustees had of done what Rita Austin said and disciplined Naz Malik on 16 October board as she stated on the Dragon's Eye programme the inevitable outcome would have been a "whitewash" leaving him free to carry on his alleged corrupt and bullying activities without challenge. There would have been no report carried out by Paul Dunn, the evidence that has come to light would been totally suppressed. This exactly why Rita Austin thinks it should have been done that way.
The Dunn report points to the fact that fact that the allegations that Naz Malik declined to address do in fact have a great deal of substance to them, this being further reinforced by interviews with former and current staff members on the Dragons Eye programme. It is wholly disgraceful that a person who is pledged to support these young people from the Future Jobs Fund should treat them in such a manner.
So CEO Naz Maliks much vaunted defence consisted mainly of statements made by his own family members, well they would of course and his flat refusal to address the human rights allegations laid against him. Not surprisingly, the board members saw through this manoeuvre for what it was a tactic of distraction designed to create confusion, in short it was total obfuscation.
Rita Austin keeps trying to deflect attention from Naz Maliks own admissions of financial irregularity by stating that it was bought before the board at a later date. The fact remains that the Naz Malik after being told by the Financial Director that he should not use AWEMA money to pay off his credit card without first going to board, Naz Malik waited until the financial director was on leave and then made out a pre-signed without anyones knowledge to pay off his credit card. Hardly honest intent is it.”

“i have been following this story with interest recently....very bemusing. the most informative part of this ongoing story has come from the Dr Austin, she has written a statment on the AWEMA website that has clearly shown where there is wrongdoing...Sibani Roy has a lot of questions to answer, how could she have allowed this whole situation to escalate in this bizarre manner..highly irresponsible. Dr Sibani Roy being the ex vice chair should have taken her responsibility much moer seroiusly, surely trustees have a duty of confidentiality too...i dont get it”

“Now come on suzgorseinon, a public enquiry? Don't you know that such an enquiry would cost money, probably about the same amount as sacking someone that admitted using public money for his own use and having unauthorised loans as well as giving himself and his daughter unauthorised payrises . Have you taken leave of your senses? I mean such an open transparent enquiry might come to the conclusion that the Chair, a former Labour Councillor in Cardiff,who got 12K for writing a report ( see below ) may have not been above board in her dealings with a fellow Labour party activist who tried to get on the voting tickett as a Labour AM previously and whose son has worked as a researcher for Edwena Hart , ( who I believe oversaw a previous enquiry into AWEMA ?) and who, also stood for election as a Labour AM in mid Wales, where good old Carwyn went canvasing with Daddy Malik for him? Sorry Suz, you've got no chance.”

“Sorry but this doesnt add up. No reputable lawyer would give their advice based on one side of the story and would insist on seeing the employee's explanation before making any recommendations. Further if you are going to completely ignore professional advice, what is the point in incurring legal fees in taking it. Another stitch up.”
